美 CFTC 申请驳回 CME 诉讼：永续合约仍是期货，CME 缺乏起诉资格

ChainThink 消息，9 月 2 日，据美国哥伦比亚特区联邦地区法院档案显示，CFTC 主席 Michael Selig 与 CFTC 已提交驳回动议，回应芝加哥商品交易所（CME）提起的诉讼。

CFTC 称，CME 指控委员会批准比特币等数字资产永续合约的命令及政策声明对其造成损害，但 CME 并未主张自身不能上线同类合约——命令已明确任何 CFTC 注册交易所均可挂牌数字商品永续合约。

CME 的核心诉求是要求将此类合约标为「Swap」而非「期货」，而委员会认为永续合约属于期货。

此外，CFTC 指出，CME 缺乏宪法第三条规定的起诉资格：其所谓「教科书式竞争损害」建立在 Kalshi 等指定合约市场可向零售投资者提供竞争产品之上，但未合理说明自身盈亏将因此受损。

CME 曾公开表示客户并不要求永续合约产品，且其加密期货成交量在命令发布后反而上升。即便改标为「Swap」，Kalshi 等仍可继续交易，分类本身无法填补所谓竞争损害。

委员会因此请求法院驳回起诉。
